1. Acceptance of Terms

By accessing and using the website at kubesentry.com and the Kubesentry runtime detection service (collectively, the "Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Use of the Service

You may use our Service for lawful purposes only. You agree not to:

• Use the Service in any way that violates applicable laws or regulations;
• Attempt to gain unauthorized access to any part of the Service or to other accounts, computer systems, or networks;
• Interfere with or disrupt the integrity or performance of the Service;
• Transmit any unsolicited or unauthorized advertising or promotional material;
• Engage in any conduct that restricts or inhibits anyone's use of the Service;
• Reverse engineer, decompile, or disassemble any portion of the Service;
• Use the Service to deploy malware, conduct denial-of-service attacks, or engage in any form of unauthorized surveillance.

3. Accounts and API Keys

You are responsible for maintaining the confidentiality of your account credentials and API keys. You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use of your account at [email protected].

Kubesentry, Inc. reserves the right to suspend or terminate accounts that violate these Terms or that appear to be involved in fraudulent or abusive activity.

4. Cluster Data and Privacy

When you deploy Kubesentry in your Kubernetes cluster, the eBPF agent processes syscall metadata within your infrastructure. No raw syscall payload data leaves your cluster by default. You retain ownership of your cluster data. By using the Service, you grant Kubesentry, Inc. the right to process this data as described in our Privacy Policy and as necessary to provide the Service.

5. Intellectual Property

The Service and its original content, features, and functionality are owned by Kubesentry, Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. The Kubesentry name, logo, and all related marks are trademarks of Kubesentry, Inc.

You retain all rights to your own policies, rules, and configurations created using the Service.

6. Subscriptions and Payment

Paid subscription plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly stated in these Terms or as required by applicable law. Kubesentry, Inc. reserves the right to change pricing with 30 days' advance notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

Failure to pay subscription fees may result in suspension or termination of your account. You are responsible for all applicable taxes.

7. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. Kubesentry, Inc. does not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free;
• The results obtained from using the Service will be accurate, complete, or reliable;
• All security threats will be detected — the Service is a detection tool and does not guarantee prevention of all security incidents.

8. Limitation of Liability

To the fullest extent permitted by law, Kubesentry, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to security incidents, data breaches, or business interruption, even if advised of the possibility of such damages. In no event shall our aggregate liability exceed the amounts paid by you to Kubesentry, Inc. in the 12 months preceding the claim.

9. External Links and Third-Party Services

Our Service may contain links to third-party websites and integrations (Slack, PagerDuty, Splunk, Elastic, Datadog, etc.). These links and integrations are provided for your convenience. Kubesentry, Inc. has no control over the content or practices of those services and accepts no responsibility for them. Your use of third-party services is governed by their own terms and privacy policies.

10. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Termination

You may terminate your account at any time by contacting [email protected]. We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

12. Changes to Terms

Kubesentry, Inc. reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in King County, Washington.
